Did you know?

In 2016, Governor Brown signed Senate Bill 1234 requiring the State’s Secure Choice Retirement Savings Investment Board to begin development of a workplace retirement savings program, known as CalSavers, for private sector workers whose employers do not offer a retirement plan.  The program is required to have minimal administrative requirements for employers and state law protects employers from any liability or fiduciary responsibilities. State law also requires the program to be exempt from the Employee Retirement Income Security Act.

The program launched a pilot initiative with a small group of participating employers in November 2018.  Beginning in July 2019, all eligible employers can register for the program.

The subject of measurements is significant. The specialist will decide the dose that is progressively fitting for the patient relying on his restorative history and current condition. Viagra 100 mg exhibits the greatest portion accessible. By and large, there are 25, 50, and 100 mg pills.

According to EDD, employers with five or more employees will be required to either provide a retirement plan for their workers or register for CalSavers and facilitate employees’ contributions to Individual Retirement Accounts.  Deadlines for compliance vary according to the size of the business.

Over 50 employees              June 30, 2021

5 or more employees          June 30, 2022

What does this mean for employers?

If your company does not already have a retirement plan in place, this new requirement may create administration hurdles. Payroll processing companies will likely expand their services to offer processing of employee contributions. 

CalSavers accounts will be Roth IRAs and will be an opt-out program which means that, unless the employees affirmatively opt-out within 30 days, they will be enrolled in the program. The employer will be required to submit contributions for each participating employee via a payroll deduction. The default savings rate is 5% of gross pay with an annual increase of 1%, capping at 8% of gross pay.  Employees will have the option to adjust the percentages.

Governor Gavin Newsom has appointed Lynne Andres as the new Chief of the Bureau of Security and Investigative Services at the California Department of Consumer Affairs. CALSAGA President David Chandler looks forward to meeting with the new Chief in the near future.

Andres has been a consultant for the California Speaker’s Office of Research and Floor Analysis since 2018. She was director of government relations for the California Academy of Physician Assistants from 2017 to 2018. Andres was a legislative director in the California State Legislature from 2005 to 2017, including in the Office of Assemblymember Joe Baca, Jr., Assemblymember Juan Arambula, Assemblymember Patty Berg, Senator Jenny Oropeza, Senator Ed Hernandez and Senator Jim Beall. She served as federal policy advisor for Governor of Michigan Jennifer Granholm from 2003 to 2004. Andres was legislative director for U.S. Congressman Bart Stupak from 1997 to 2003. She earned a Juris Doctor degree from Concord Law School.

We have enjoyed the working relationship CALSAGA has developed with Chief Woo and wish him the best in his future endeavors.

Do you have security officers who patrol the streets of the City of Los Angeles?
Did you know that you must register these officers with bothBSIS and the Los Angeles Police Commission?
The City of Los Angeles is issuing administrative citations to security officers who are patrolling the city streets without proper registration.

We encourage you to review the Private Patrol Service Regulations below which you must adhere to.

In part, the Los Angeles Municipal Code 52.34 states:

It shall be unlawful for any person to perform the duties of a street patrol officer in the City of Los Angeles without first obtaining a Guard Registration card as required by the State of California and registering with the City.  Upon the registration being accepted by the City, the Board of Police Commissioners may issue a permit which shall be subject to all of the provisions of Chapter 10 of this Code, including all the rights, regulations, and due process procedures contained therein.  The Board of Police Commissioners shall retain street patrol officer permits in its files.

Applicant must include the following when submitting the original application to Commission Investigation Division:

  1.       Valid California driver’s license
  2.       Valid guard card
  3.       Valid firearm permit (if using firearm)
  4.       Valid baton permit (if using baton)
  5.       A signed letter of employment by the registered employer
  6.       Any other applicable permits

Note: A background check is made to determine truthfulness of applicant as to criminal history or detect any adverse information. A person on probation, parole, or bearing an invalid driver’s license will not be issued a registration card. The application in itself does not guarantee issuance of Police Commission Registration card.

The board of police commissioners may revoke the registration if applicant is convicted of criminal activity subsequent to granting of permit.

As we brought to your attention in December, SB1343 requires all employers with 5 or more employees to provide sexual harassment prevention training to all employees and supervisors. The bill was effective January 1, 2019 with compliance required by January 1, 2020. SB1343 requires that the training be interactive and provided by facilitators who have knowledge and expertise in harassment, discrimination and retaliation.

We understand the potential logistics hurdles that these requirements present. As an association we strive to help you run your business as professionally and efficiently as possible.

Department of Justice Issues Bulletin to CA Law Enforcement Agencies

After much hard work on the part of the association, CALSAGA is very pleased to report that the Department of Justice has issued a bulletin to California law enforcement agencies concerning AB 2220.

AB 2220 allows a Private Patrol Operator to be a registered owner of a firearm. Additionally, this bill allows a security officer to be assigned a firearm by the PPO and for a firearm custodian to be designated by the PPO. Previous practices and statutes authorized the purchase, registration, and ownership of firearms by an individual, but not by a business entity. AB 2220 authorized business ownership and registration of firearms in the case of PPOs who are actively providing armed private contract security services. A PPO may assign firearms it owns to employees who are licensed to carry firearms by the Bureau of Security and Investigative Services.

As a result of AB 2220, a problem presented itself because the current Dealer Record of Sale (DROS) Entry System (DES) is not capable of recognizing a business as a firearm purchaser or owner. The Department of Justice intends to modify the DES and Automated Firearm System (AFS) to allow a PPO to be listed as the purchaser and registered owner of a firearm. Additionally, the DOJ intends to create a process for PPOs to submit a Certificate of Assignment to identify the employee of the PPO in AFS who has been assigned a firearm owned by the PPO. These changes are anticipated to be completed by July 1, 2019.

Those intentions were stated in the bulletin to law enforcement agencies. Furthermore, the bulletin cautioned that law enforcement personnel may continue to encounter armed security officers who have the requisite permits and qualifications to carry a firearm in the course of their duties, but who are not actually the registered owners of the firearm. Law enforcement agencies are advised that an assignment of a firearm to an eligible and licensed security officer by a PPO is not a violation of Penal Code 27545.
